Scope of Appropriation

Reasons for Change in Appropriation

This appropriation decreased by $600,000 to $4.463 million for 2018/19 due to a fiscally neutral transfer to the Court and Coroner Related Costs appropriation to cover increased demand on Family Court professional services.

Community Magistrates Salaries and Allowances PLA (M19)
Scope of Appropriation
This appropriation is limited to the remuneration and allowances of Community Magistrates as authorised by section 60 of the District Court Act 2016.
Reasons for Change in Appropriation

This appropriation increased by $300,000 to $1.299 million for 2018/19 to reflect expected expenditure in line with the Judicial and Statutory Officers Fees Review 2017/18.

Court and Coroner Related Costs (M19)
Scope of Appropriation
This appropriation is limited to funding professional and administrative services provided to or directed by courts and coroners, including costs that are required by legislation and costs incurred by Visiting Justices.
Reasons for Change in Appropriation

This appropriation increased by $600,000 to $109.739 million for 2018/19 due to a fiscally neutral transfer from the Abortion Supervisory Committee - Certifying Consultants Fees appropriation to cover increased demand on Family Court professional services.

District Court Judges' Salaries and Allowances PLA (M19)
Scope of Appropriation
This appropriation is limited to the remuneration and allowances of Judges in the District Court, including the Environment Court, as authorised by section 34 of the District Court Act 2016.
Reasons for Change in Appropriation

This appropriation decreased by $1.848 million to $74.262 million for 2018/19 due to a $6 million forecast reduction in salaries and allowances to reflect expected expenditure in line with the Judicial Salaries and Allowances (2018/19) Determination 2018.

This was partly offset by an increase of $4.152 million for the valuation of the sabbatical leave liability for Judges.

Employment Court Judges' Salaries and Allowances PLA (M19)
Scope of Appropriation
This appropriation is limited to costs related to the terms and conditions of remuneration for Judges and acting warranted Judges in the Employment Court incurred pursuant to s.206 Employment Relations Act 2000.
Reasons for Change in Appropriation

The appropriation increased by $161,000 to $4.352 million for 2018/19 due to the valuation of the sabbatical leave liability for Judges.

Impairment of Fines Receivable (M19)
Scope of Appropriation
This appropriation is limited to allowing for the impairment of fines, court costs and enforcement fees in accordance with Generally Accepted Accounting Practice.
Reasons for Change in Appropriation

This appropriation has decreased by $11.531 million to $2 million for 2018/19 due to the application of the accounting treatment required under the Public Benefit Entity International Public Sector Accounting Standard - Revenue from Non-Exchange Transactions (PBE IPSAS 23).

Justices of the Peace Association (M19)
Scope of Appropriation
This appropriation is limited to the cost of administrative services from the Royal Federation of Justices including training and rostering Justices of the Peace for court hearings, and training for Visiting Justices.
Reasons for Change in Appropriation

This appropriation has increased by $40,000 to $450,000 for 2018/19 due to a fiscally neutral transfer from the Courts, Tribunals and Other Authorities Services, including the Collection and Enforcement of Fines and Civil Debts Services appropriation to cover an increase in the fee paid to the Royal Federation of NZ Justices' Associations Incorporated.

Maori Land Court Judges' Salaries and Allowances PLA (M19)
Scope of Appropriation
This appropriation is limited to costs related to the terms and conditions of remuneration for Judges and acting warranted Judges in the Maori Land Court incurred pursuant to s.13 Te Ture Whenua Maori Land Act 1993.
Reasons for Change in Appropriation

This appropriation increased by $1.612 million to $7.619 million for 2018/19 due to the valuation of the sabbatical leave liability for Judges.

Scope of Appropriation
This appropriation is limited to the remuneration and allowances of Judges of the Supreme Court, Court of Appeal and High Court as authorised by section 135 of the Senior Courts Act 2016.
Reasons for Change in Appropriation

This appropriation increased by $3.962 million to $47.453 million for 2018/19 due to:

  • an increase of $2.700 million in accordance with the Judicial Salaries and Allowances (2018/19) Determination 2018, and
  • an increase of $1.262 million for the valuation of the sabbatical leave liability for Judges.
Tribunal Related Fees and Expenses (M19)
Scope of Appropriation
This appropriation is limited to funding remuneration, allowances, or fees for the Chairs, Members, Adjudicators and Assessors of Specialist Tribunals, and expenses incurred by those Chairs, Members, Adjudicators and Assessors in relation to Tribunal work.
Reasons for Change in Appropriation

This appropriation decreased by $257,000 to $16.828 million for 2018/19 due to:

  • an expense transfer of $2.482 million from 2018/19 to 2019/20 to fund the work programme of the Canterbury Earthquakes Insurance Tribunal, to reflect the expected dates for the enactment of legislation, and
  • an expense transfer of $1.400 million from 2018/19 to 2019/20 to meet costs associated with addressing the backlog of cases for the Human Rights Review Tribunal.

This was partly offset by:

  • a fiscally neutral transfer of $1.800 million from Vote Building and Housing Greater Christchurch Recovery appropriation for the cost of specialist technical experts for the Canterbury Earthquakes Insurance Tribunal
  • a fiscally neutral transfer of $1.609 million from the Court and Coroner Related Costs appropriation to meet the costs associated with addressing the backlog of cases for the Human Rights Review Tribunal. This funding was previously carried forward from 2017/18 in the Court and Coroner Related Costs appropriation to 2018/19 to fund this cost pressure, and
  • a fiscally neutral transfer of $216,000 from Courts, Tribunals and Other Authorities Services, including Collection and Enforcement of Fines and Civil Debts Services appropriation for the cost of additional fulltime Immigration Protection Tribunal members.

Reasons for Change in Appropriation

This appropriation increased by $4.470 million to $473.758 million for 2018/19 due to:

  • an increase of $4.122 million to improve the base pay of Ministry of Justice employees
  • an increase in capital charge of $2.699 million on the revaluation of land and buildings as at 30 June 2018
  • additional funding for the Whenua Maori Programme of $1.552 million which supports Maori land owners to achieve their aspirations in respect of their whenua
  • a fiscally neutral transfer of $1 million from the Court and Coroner Related Costs appropriation to cover support costs for the Human Rights Review Tribunal to address the current backlog of cases. This funding was previously carried forward from 2017/18 in the Court and Coroner Related Costs appropriation to 2018/19 to fund this cost pressure
  • a fiscally neutral adjustment of $443,000 for employees seconded to other government agencies
  • a fiscally neutral adjustment of $418,000 for technology services in the Christchurch Justice and Emergency Services Precinct, funded by additional revenue received from building tenants
  • funding of $314,000 from the Effective Justice Fund tagged contingency to improve scheduling of court hearings across the District Courts, and
  • a fiscally neutral adjustment of $178,000 for the Justice Centre lease costs, funded by additional revenue received from building tenants.

This was partly offset by:

  • a fiscally neutral adjustment of $3.299 million to Vote Justice to reflect the allocation of Ministry overheads in 2018/19
  • an expense transfer of $800,000 from 2018/19 to 2019/20 to meet costs associated with addressing the backlog of cases from the Human Rights Review Tribunal
  • an expense transfer of $720,000 from 2018/19 to 2019/20 to reflect the expected dates for the enactment of legislation for the Family Violence Law Reform Programme
  • a fiscally neutral transfer of $680,000 to Vote Justice for the Family Violence and Sexual Violence Joint Venture work programme to cover the development of a workforce capability plan for government and non-government agencies
  • an expense transfer of $300,000 from 2018/19 to 2019/20 due to delays in the Whenua Maori Programme
  • a fiscally neutral transfer of $216,000 to the Tribunal Related Fees and Expenses appropriation for the cost of additional fulltime Immigration Protection Tribunal members
  • an expense transfer of $135,000 from 2018/19 to 2019/20 to reflect the expected dates for the enactment of legislation associated with the Canterbury Earthquakes Insurance Tribunal
  • a fiscally neutral transfer of $66,000 to Vote Justice to fund the ongoing costs of Community Law Centres o Aotearoa, and
  • a fiscally neutral transfer of $40,000 to the Justices of the Peace Association appropriation to cover an increase in the fee paid to the Royal Federation of NZ Justices' Associations Incorporated.
