This appropriation is intended to achieve the efficient running of the courts system by providing payment of salaries and allowances to Community Magistrates.

How Performance will be Assessed and End of Year Reporting Requirements

An exemption was granted under s15D(2)(b)(ii) of the PFA, as additional performance information is unlikely to be informative because this appropriation is solely for payments under the remuneration provisions of the District Court Act 2016.

Reasons for Change in Appropriation

This is a new appropriation following the enactment of the District Court Act 2016. This appropriation has increased by $340,000 for 2016/17 due to a transfer from the multi-category expenses and capital expenditure for Courts, Tribunals and Other Authorities Services, including the Collection and Enforcement of Fines and Civil Debts Services: District Court Services.

This appropriation is limited to funding professional and administrative services provided to or directed by courts and coroners, including costs that are required by legislation and costs incurred by Visiting Justices.

Reasons for Change in Appropriation#

This appropriation has increased by $5.532 million to $84.524 million for 2016/17 due to:

  • an increase of $3.500 million to fund increased court ordered services for Family Court and Youth Court professionals, driven by increased court business and the increasing recognition of mental health and cultural issues as drivers of offending and/or care and protection decisions
  • an increase of $1.700 million to fund increased costs for coroner directed post mortems, and
  • a transfer of $332,000 from the Justice Sector Fund to fund intervention programmes to reduce family violence and sexual violence such as pilots to support access to protection orders and supervised child handover.

Scope of Appropriation#

This appropriation is limited to costs related to the terms and conditions of remuneration for Judges, and acting warranted Judges in the District Court and Environment Court incurred pursuant to s.6 District Courts Act 1947.

Reasons for Change in Appropriation#

The appropriation has decreased by $28.216 million to $56.433 million for 2016/17 due to transfers of funds to two new appropriations created as a result of the enactment of the District Court Act 2016 effective from 1st March 2017. The decrease is due to:

  • a transfer of $21.316 million to the non-departmental other expenses: District Court Judges' Salaries and Allowances PLA, and
  • a transfer of $6.900 million to the non-departmental other expenses: District Court Part-time or Acting Judges' Salaries and Allowances.

Reasons for Change in Appropriation#

The enactment of the District Court Act 2016 resulted in the set up of three new appropriations from the previous District Court and Environment Court Judges' Salaries and Allowances PLA, effective 1 March 2017. This is one of the newly created appropriations, with an appropriation of $27.191 million for 2016/17. The increase is due to:

  • a transfer of $21.316 million from the non-departmental other expenses: District Court and Environment Court Judges' Salaries and Allowances PLA
  • an increase $4.533 million in accordance with the Judicial Salaries and Allowances Determination 2017, and
  • an increase of $1.704 million to account for an adjustment for the sabbatical leave liability accrued by Judges.

Offset by:

  • a decrease of $362,000 owing to a transfer to the non-departmental other expenses: District Court Part-time and Acting Judges' Salaries and Allowances.

  • an increase $2.917 million in accordance with the Judicial Salaries and Allowances Determination 2017, and

Reasons for Change in Appropriation

Collection and Enforcement of Fines and Civil Debts Services

The category has decreased by $9.139 million to $56.855 million for 2016/17, due to:

  • a decrease of $7.883 million owing to a transfer to other appropriations administered by the Ministry of Justice to fund priorities, address cost pressures, and to allow for movements in the allocation of Ministry overheads in the 2016/17 financial year
  • a decrease of $1.201 million, following the change to the capital charge rate from 8% to 7% for the first half of the year, and to 6% for the remaining financial year, and
  • a decrease of $57,000 to reflect a realignment of existing capital charge baseline funding into the newly set up appropriation, Vote Justice departmental output expenses: Justice and Emergency Agencies Property Shared Services.

Offset by:

  • an increase of $2,000 funded from revenue received for employees seconded to other government agencies.
District Court Services

The category has decreased by $7.489 million to $224.772 million for 2016/17, due to:

  • a decrease of $5.468 million following the change to the capital charge rate from 8% to 7% for the first half of the year, and to 6% for the remaining financial year
  • a decrease of $3.485 million owing to a transfer to other appropriations administered by the Ministry of Justice to fund priorities, address cost pressures, and to allow for movements in the allocation of Ministry overheads in the 2016/17 financial year
  • a decrease of $1.349 million to reflect a realignment of existing capital charge baseline funding into the newly set up appropriation, Vote Justice departmental output expenses: Justice and Emergency Agencies Property Shared Services
  • a decrease of $1.246 million owing to a transfer of funds to 2017/18 to reflect that the majority of the Christchurch Justice Emergency Services Precinct decanting costs are now expected to occur in early 2017/18, and
  • a decrease of $340,000 owing to a transfer to the non-departmental other expenses: Community Magistrates Salaries and Allowances PLA appropriation as a result of the enactment of the District Court Act 2016.

  • an increase of $2.279 million, received from the Justice Sector Fund to fund the additional funding required to complete the construction and the decanting costs for Christchurch Justice Emergency Services Precinct
  • an increase of $680,000 to fund the Integrated Safety Response (ISR) service gap to allow the Christchurch ISR pilot to continue its work to combat family and sexual violence
  • an increase of $622,000, received for the funding of capital charge and depreciation costs for the earthquake strengthening and refurbishment of the Dunedin Courthouse

Higher Courts Services

The category has decreased by $4.628 million to $67.363 million for 2016/17, due to:

  • a decrease of $2.753 million owing to a transfer to other appropriations administered by the Ministry of Justice to fund priorities, address cost pressures, and to allow for movements in the allocation of Ministry overheads in the 2016/17 financial year
  • a decrease of $1.987 million, following the change to the capital charge rate from 8% to 7% for the first half of the year, and to 6% for the remaining financial year
  • a decrease of $483,000 to reflect a realignment of existing capital charge baseline funding into the newly set up appropriation, Vote Justice departmental output expenses: Justice and Emergency Agencies Property Shared Services, and
  • a decrease of $409,000 owing to a transfer of funds to 2017/18 to reflect that majority of the decanting costs for Christchurch Justice Emergency Services Precinct is now expected to occur in early 2017/18.

Offset by:

  • an increase of $747,000, received from the Justice Sector Fund to fund the additional funding required to complete the construction and the decanting costs for Christchurch Justice Emergency Services Precinct
  • an increase of $218,000 funded from revenue received for employees seconded to other government agencies, and

The category has increased by $841,000 to $89.142 million for 2016/17, due to:

  • an increase of $2.142 million owing to a transfer to other appropriations administered by the Ministry of Justice to fund priorities, address cost pressures, and to allow for movements in the allocation of Ministry overheads in the 2016/17 financial year
  • an increase of $904,000, received from the Justice Sector Fund to fund the additional funding required to complete the construction and the decanting costs for Christchurch Justice Emergency Services Precinct
  • an increase of $217,000 funded from revenue received for employees seconded to other government agencies
  • an increase of $44,000, received for the funding of capital charge and depreciation costs for the earthquake strengthening and refurbishment of the Dunedin Courthouse, and
  • an increase of $15,000 to fund costs associated with the work on the Maori Land Service project.

Offset by:

  • a decrease of $1.552 million, following the change to the capital charge rate from 8% to 7% for the first half of the year, and to 6% for the remaining financial year
