Overview of the Vote#

The Minister for Treaty of Waitangi Negotiations is responsible for appropriations in Vote Treaty Negotiations for the 2017/18 financial year including a multi-year appropriation and a range of annual appropriations.

Vote Treaty Negotiations contains a multi-year appropriation of $1,400 million for the five-year period 2017 to 2021. This appropriation is for the settlement of historical Treaty of Waitangi claims and provides for the payment of redress through the transfer of assets (cash and property) from the Crown to claimant groups, and for the payment of interest on settlement redress.

In addition, annual appropriations sought for Vote Treaty Negotiations in 2017/18 total over $50 million. This is intended to be spent as follows:

  • a total of just over $8 million (16% of the Vote) for claimant funding to support the settlement of historical Treaty claims
  • a total of over $8 million (17% of the Vote) for contributions toward determining customary interests in the Marine and Coastal Area
  • a total of over $33 million (67% of the Vote) for the negotiation and implementation of historical Treaty claims, and administration and implementation of the Marine and Coastal Area (Takutai Moana) Act 2011.

Output Expenses

The appropriation was higher in 2016/17 due to transfers from 2015/16 to fund priority negotiations with certain groups, settlement expenses and the Marine and Coastal Area (MACA) website.

Funding has been approved to 2018/19 to broaden the geographic and population reach of Treaty settlement negotiations with key groups. The appropriation returns to baseline in 2019/20.

Other Expenses

During 2016/17 a number of significant Treaty settlement milestones were reached. From 2017/18 onwards, expenditure on Treaty settlements is expected to remain relatively constant over the forecast period.

Multi-Year Appropriations

The $379.146 million estimated actual in the Historical Treaty of Waitangi Settlements multi-year appropriation reflects the initialling of a number of settlements during 2016/17. The budget of $350 million per annum for the multi-year appropriation remains constant over the out-years.

Reasons for Change in Appropriation

The decrease in this appropriation of $2.697 million for 2017/18 is due to:

  • a $6.997 million expense transfer to 2016/17 from 2015/16 to ensure that unspent funds are retained for expected applications from claimants.

Offset by:

  • a $4.300 million transfer in 2016/17 to the Multi-Category Expenses and Capital Expenditure for Treaty Negotiations and Marine and Coastal Area (Takutai Moana) Act, to fund priority negotiations with certain groups in Tai Tokerau/Northland, Bay of Plenty, Waikato, Manawatu-Whanganui and Taranaki.

In 2017/18 the appropriation returns to baseline.

Reasons for Change in Appropriation#

The increase in this appropriation of $6.755 million for 2017/18 is mainly due to:

  • a one off transfer of $9 million to Vote Finance in 2016/17 relating to the claims of an Ahu Whenua Trust
  • a one off transfer of $5 million to Vote Māori Development in 2016/17 to fund development projects of the Parihaka community, and
  • a transfer of $4 million from 2015/16 to 2017/18 to match changes in the Treaty negotiations work programme.

This was offset by a transfer of $10.545 million from prior years to 2016/17 to realign funding with anticipated applications for recognition under the Marine and Coastal Area (Takutai Moana) Act 2011.

Note 1 - This indicator provides a standardised score for technical quality reviews of policy advice, which are undertaken by a third party assessor. The review may include an assessment of clarity, accuracy, analytical rigour, fitness for purpose, and relevance.

Note 2 - The Ministry does not have full control over the achievement of these measures as it is partially reliant on claimant groups undertaking the work required by them to achieve a mandate to negotiate, broadly agree to the Crown's offer and move steadily towards the conclusion of negotiations.

Note 3 - A Deed of Mandate is a formal statement prepared by a claimant group stating who is appointed to represent them in negotiations with the Crown, and how the Mandate was approved by the claimant group. If satisfied, the Minister for Treaty of Waitangi Negotiations and the Minister for Māori Development recognise the Mandate on behalf of the Crown.

Note 4 - An Agreement in Principle is agreed between the Crown and a claimant group. The document describes the broad outline of a settlement package and is signed by the claimant group and the Minister for Treaty of Waitangi Negotiations.

Note 5 - A Deed of Settlement is the complete, detailed and formal settlement agreement between the Crown and the claimant group.

Note 6 - Engagement under the MACA Act means a decision made by the Minister for Treaty of Waitangi Negotiations to investigate an application more fully to see whether it meets the criteria under the Act to grant customary marine title or protected customary rights. It is part of the formal process for determining these rights.

Reasons for Change in Appropriation

Treaty Negotiations and Marine and Coastal Area (Takutai Moana) Act (MCA)

The decrease in this appropriation of $2.204 million for 2017/18 is mainly due to:

  • transfers from 2015/16 to 2016/17 to fund legal and surveying expenses relating to settlement negotiations, which were expected to be incurred in 2016/17, and
  • lower funding for revenue received for employees seconded to other government agencies.
